Under MCA § 87-1-102, all wild bison, deer, elk, antelope, moose, caribou, mountain sheep, mountain goats, mountain lions, bears (other than grizzlies under federal ESA), wild turkeys, and all wild birds are the property of the state of Montana. Taking any such wildlife without a valid license and tag constitutes criminal poaching regardless of where the taking occurs.
Hunting without a license, hunting in closed seasons, exceeding bag limits, or taking protected species carries criminal penalties under Montana law.
